All LCAs will be affected to some extent by the recommissioning process – this is how it goes:
CA wins MaPS and/or HtC
you are in the supply chain or you leave the supply chain . If it’s HtC then TUPE will apply to your team whether or not you are in the supply chain. So if you are losing your contract your staff may be transferred over and if you are staying in the chain then you will be receiving in more staff than posts via TUPE and will have to restructure and carry out redundancies- with loads of pitfalls and possible legal challenges
CA doesn’t win MaPS and/or HtC
as above for TUPE and HtC and restructuring probably also needed for nearly all current MaPS contract holders – major redundancies possible with all the pitfalls and risks. At the same time as LCAs work on this, CA will be making posts redundant on a large scale.
So, we will all need at a minimum a good grounding in TUPE and many of us may need help on other issues – the peer group has good contacts for legal advice and several of us are working on collaboration, partnerships etc to enable us to keep the service running. New ways of working that will protect LCAs by helping each other and cutting out duplication etc. This will be the key topic at our Fed Conference.
CA is already working with 56 LCAs who are facing serious challenges in terms of viability and CA has put on some webinars to help people navigate this.
